Can I record my spouse? (U.S. & Canada)
Short answer: it depends — and getting it wrong can create criminal risk.
United States
Many states are one-party consent (you can record if you are in the conversation). Some are all-party (everyone must agree). Cross-state calls are messy. Lists change — verify.
Canada
Federal criminal law (Criminal Code s.184) is generally one-party consent when you are a participant. Recording conversations you are not part of is typically illegal. Family courts still decide whether to admit a recording. Provincial privacy and workplace rules can add limits.
